This Privacy Policy sets out the privacy practices of the Website located at www.pieram.com, owned and operated by Pier Asset Management and which is defined in our Terms of Use (of which this Privacy Policy forms a part) as the “Website.”  This Privacy Policy describes the types of information we gather about you while you are using the Website, and the ways in which we use and share your information.  This Privacy Policy does not apply to information you directly or expressly provide to us or that we may collect offline or through other means (for example, at a live event or through the mail).  Any terms that are not defined in this Privacy Policy shall have the meaning ascribed to them in our Terms of Use.

Please read this Privacy Policy carefully, since it forms part of the Terms of Use that together constitute a binding legal agreement between you and us and as noted in our Terms of Use, by using or attempting to use our Website, you accept, without limitation or qualification, and are agreeing to be bound by and comply with everything contained in our Terms of Use, including this Privacy Policy.  If you do not agree to any of these provisions, do not use or attempt to use our Website.

Collection and Use of Personally Identifiable Information

We do not collect personally identifiable information about you on or through our Website.

Collection and Use of Technical Information

In some cases, when you visit our Website, we and our operational service providers may collect and store certain technical information that our technology is able to detect automatically, such as your location data, your device’s IP address, MAC address, the type of browser and operating system you are using and your device identification number.  We don’t collect personally identifiable information about you in this process and we use this technical information to help administer and improve our Website and to enable us to provide users like you, a more customized or personalized experience on our Website.  We may study aggregate data in order to enhance our existing services or develop new services.  In limited situations, we may use IP addresses and/or MAC addresses to identify a device when we feel it is necessary to enforce compliance with our Terms of Use or to protect our Website, our users or other individuals or if we know or have reason to believe any law or regulation is being violated.

Children’s Privacy Statement

The Website is not directed to children under the age of 13 and we do NOT knowingly collect personally identifiable information from children under the age of 13 as part of the Website.  If we become aware that we have inadvertently received personally identifiable information from a user under the age of 13, we will take the appropriate steps to delete such information from our records.  We do not condition the participation of a child under 13 in the Website’s online activities on providing personally identifiable information.

California Privacy Rights

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits users who are clients of ours and who are California residents to request and obtain from us once a year, free of charge, information about the personally identifiable information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year.  If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year.  If you are a California resident and would like to make such a request, please submit your request in writing to Chief Compliance Officer, Pier Asset Management LLC, 2425 Olympic Blvd., Suite 125E, Santa Monica, California 90404.

In addition, under California Business and Professions Code Section 22575, website operators are required to disclose how they respond to Web browser “do not track” signals or other similar mechanisms.  We do not utilize any tracking functionalities on our Website so this requirement does not apply to us.  This law also requires website operators to disclose whether third parties may collect personally identifiable information about their users’ online activities over time and across different websites when the users use the operator’s website.  We do not permit third parties to collect personality identifiable information from our users in this context.

Changes to our Privacy Policy

You understand that we have the right to change this Privacy Policy from time to time, subject always to applicable law and regulation. If we make changes, we will post the revised Privacy Policy on our Website and update the “Last Updated” date to reflect the date of the changes.
